HOUSE CONCURRENT
RESOLUTION
REQUESTING THE AUDITOR TO CONDUCT A MANAGEMENT AUDIT OF THE JUDICIARY'S PROGRAMS FOR PERSONS SENTENCED TO COMMUNITY SERVICE.
WHEREAS, under present law the courts are authorized to sentence a convicted defendant to perform services for the community under the supervision of a government agency or benevolent or charitable organization or other community service group or appropriate supervisor; and
WHEREAS, present law also requires all persons sentenced to perform community service to be screened and assessed for appropriate placement by a governmental agency that coordinates public service work placement; and
WHEREAS, such screening and assessment is deemed necessary to reduce instances of inappropriate placements that may jeopardize the safety of the governmental agency that coordinates public service work placement, the public, or the offender; and
WHEREAS, community service sentencing requires the Judiciary to play an active and central role in coordinating the availability and delivery of community service programs for offenders; and
WHEREAS, the Auditor is mandated to conduct post-audits of the transactions, accounts, programs, and performance of all departments, offices, and agencies of the State and its political subdivisions; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Auditor is requested to conduct a management audit of the Judiciary's programs for persons sentenced to community service; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit a report to the Legislature not later than twenty days prior to the convening of the Regular Session of 2008; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Chief Justice of the Supreme Court.
