HOUSE CONCURRENT

RESOLUTION

 

 

requesting the department of land and natural resources to determine which violations require the time and resources of the district court for adjudication.

 

 

 


     WHEREAS, many Hawaii residents enjoy the recreational sport of boating in the waters in and around the State of Hawaii; and

 

     WHEREAS, most of these boaters are law-abiding citizens who follow the laws, rules, and regulations of the State and the Department of Land and Natural Resources; and

 

     WHEREAS, occasionally, some boaters have been cited for a variety of infractions, some of which threatened the safety of property or person, and some which did not; and

 

     WHEREAS, currently, the Hawaii Revised Statutes compels all violators to adjudicate their matters in district court; and

 

     WHEREAS, some of the offenses are not threatening to life or property and could be analogized to traffic parking, sticker violations, or other non-moving violations; and

 

     WHEREAS, while adjudication in district court is desirable for boating offenses that threaten life or property, adjudication in district court for lesser offenses which do not threaten life or property does not seem to be a prudent and efficient use of time and resources; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Department of Land and Natural Resources is requested to determine which violations require the time and resources of the district court for adjudication and which violations do not require district court adjudication; and

 

     BE IT FURTHER RESOLVED that such determinations be drafted into proposed legislation and be submitted to the Legislature no later than 20 days prior to the convening of the Regular Session of 2008; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources.
