HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE AUDITOR TO PERFORM A sunrise review TO DETERMINE WHETHER home inspectors SHOULD BE LICENSED BY THE DEPARTMENT OF COMMERCE AND CONSUMER AFFAIRS.

 

 

 


     WHEREAS, home owners often find it necessary to obtain the services of home inspectors; and

 

     WHEREAS, home inspectors are, in many cases, vital to the safety and protection of home properties; and

 

     WHEREAS, due to the necessary role played by home inspectors, it is important to ensure that these individuals measure up to certain standards of knowledge and experience; and

 

     WHEREAS, H.B. No. 182, introduced during the Regular Session of 2007, will prohibit some persons from holding themselves out as home inspectors unless they are licensed with the home inspector licensing board under the Department of Commerce and Consumer Affairs; and

 

     WHEREAS, section 26H-6, Hawaii Revised Statutes requires the Auditor to conduct sunrise reviews of specific measures identified through a concurrent resolution that, if enacted, would subject unregulated professions and occupations to licensing or other regulatory controls; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-fourth Legislature of the State of Hawaii, Regular Session of 2007, the Senate concurring, that the Auditor is requested to perform a sunrise review to determine whether home inspectors should be licensed by a home inspector licensing board under the Department of Commerce and Consumer Affairs; and

 

     BE IT FURTHER RESOLVED that the Auditor is requested to submit to the Legislature a report of any findings and recommendations, including proposed legislation, not later than twenty days prior to the convening of the Regular Session of 2008; and

 

     BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Auditor and Director of Commerce and Consumer Affairs.
