A BILL FOR AN ACT


 

 

RELATING TO ENVIRONMENTAL IMPACT STATEMENTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 343, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§343-    Duration.  A final environmental impact statement, once accepted, shall remain valid for a period of       years from the date of acceptance, unless, during that period:

     (1)  Substantial changes are proposed in the project that will require major revisions of the environmental impact statement;

     (2)  Substantial changes occur with respect to the circumstances under which the project is being undertaken that will require major revisions in the environmental impact statement; or

     (3)  New information becomes available that was not known and could not have been known at the time the environmental impact statement was certified as complete."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
