A BILL FOR AN ACT
relating to motor sports facility.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the erstwhile motor sports facility in leeward Oahu allowed motor vehicles to compete in motor sports under safe conditions and provided a vital service to the community by keeping motor racing and all of its inherent dangers off the public streets and freeways. A motor sports facility can also be a benefit to public safety by providing a place to safely train law enforcement personnel from the State and the counties, as well as the general public, in the safe handling of motor vehicles.
The purpose of this Act is to determine the cost of developing and operating a new motor sports facility in the State.
SECTION 2. (a) The department of accounting and general services shall conduct a study to determine the cost of developing an all-purpose motor sports facility in the State, including acquisition of land, construction, and cost of start-up, maintenance, and operation.
(b) The department shall consider at least the following cost factors:
(1) Acquisition of adequate land by purchase, lease, exchange, or any other appropriate means, including financing;
(2) Planning, design, and construction of the facility, including:
(A) Multi-purpose driving surfaces, barriers, fencing, lighting, and driver communication systems;
(B) Training and educational facilities, including classrooms;
(C) Safety and first response medical facility and safety containment systems;
(D) Participant and spectator accommodations, including maintenance, security, storage, and other supporting facilities; and
(E) Equipment intended for permanent use in the facility.
(3) Initial costs of start-up, if any;
(4) Routine maintenance of the facility for the first ten years; and
(5) Routine operating costs, taking into account any fees that may be charged to users of the facility.
(c) The department shall submit a written final report to the legislature no later than twenty days prior to the convening of the regular session of 2008.
SECTION 3. This Act shall take effect upon its approval.
