A BILL FOR AN ACT


 

 

relating to solid waste management.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Communities across the state have been adversely affected by the presence of solid waste disposal sites.  Operators of many solid waste disposal sites are reluctant to engage in comprehensive mitigation efforts in surrounding communities.  Many of these communities need to receive positive benefits for hosting sites that collect waste from other communities.

     The purpose of this Act is to require operators of landfills and other solid waste sites to collect a surcharge which will be pooled and used for community enhancement and beautification.

     SECTION 2.  Chapter 342G, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§342G-      Community enhancement surcharge.  (a)  There is established a community enhancement surcharge.  The surcharge shall be 20 cents per ton of solid waste disposed of within the state at permitted or unpermitted solid waste facilities.  The surcharge shall be paid by the person disposing of the waste.  The owner or operator of the facility shall transfer all moneys collected from the surcharge to the department through a quarterly reporting and payment schedule.  Estimates of quarterly solid waste disposal shall be submitted prior to the first day of each quarter, and the transfer of moneys shall occur within thirty days of the end of each quarter.

     (b)  The surcharge collected pursuant to this section shall be deposited into the community enhancement special fund.

     §342G-      Community enhancement special fund.  (a)  There is established in the state treasury the community enhancement special fund.  The fund may receive legislative appropriations, grants, and gifts.

     (b)  All moneys collected pursuant to section 342G-____ shall be deposited into the community enhancement special fund.   All interest earned or accrued on moneys deposited into the fund shall become a part of the fund.

     (c)  The community enhancement special fund shall only fund legislative grant-in-aid requests from areas where a solid waste disposal facility is located."

     SECTION 3.  New statutory material is underscored.


     SECTION 4.  This Act shall take effect on July 1, 2007.
