RELATING TO THE HAWAII YOUTH CORRECTIONAL FACILITY.

Creates a Hawaii commission on juvenile justice to oversee the Hawaii youth correctional facility and the office of youth services. Attaches for administrative purposes to the department of human services. Appropriates funds.

RELATING TO A COMMISSION ON FATHERHOOD.

Replaces the director of the office of children and youth with the chief justice or his designee as a member of the commission.

Establishes a Foster Children's Bill of Rights.

Clarifies the importance of kinship placement for temporary foster placement and adoption; affirms the importance of the child's present attachment and bonding to present caregivers, whether kin or non-kin.

RELATING TO FOSTER CHILDREN.

Allows foster children to apply for a driver's license with the written consent of the Department of Human Services. Requires a foster child's natural parents to pay for the child's car insurance and provides for free insurance if the child's parents are unable to pay. Allows higher education board allowances to be paid directly to former foster children.

RELATING TO FAMILY SERVICE CENTERS.

Creates the community-based, family-centered models special account to award grants to establish and maintain community-based, family-centered models throughout the State. Appropriates funds for the Even Start program.

RELATING TO INCOME TAX.

Establishes a tax credit for tuition and fees of parents who enroll in parenting and child development classes.

RELATING TO FEDERAL REVENUE MAXIMIZATION IN THE JUDICIARY.

MAKING AN APPROPRIATION FOR SCHOOL-BASED SUBSTANCE ABUSE TREATMENT FOR MIDDLE SCHOOLS.

Appropriates funds to DOH to support increased school-based substance abuse treatment programs for middle schools.

MAKES APPROPRIATIONS FOR SCHOOL-BASED SUBSTANCE ABUSE TREATMENT PROGRAMS FOR ADOLESCENTS.

Extends adolescent school-based substance abuse treatment programs to middle and intermediate schools, giving priority to schools with the greatest need. Makes appropriation.

MAKING AN APPROPRIATION FOR SUBSTANCE ABUSE AND TREATMENT EDUCATION.

Appropriates funds for DOH, in coordination with DOE, to establish a substance abuse and treatment education program in public middle schools.

MAKING AN APPROPRIATION TO SUPPORT ADDITIONAL PHYSICAL ACTIVITY REQUIREMENT IN PUBLIC SCHOOLS.

Requires all elementary and middle schools to include in their curriculum at least 200 minutes of physical activities every 10 school days. Makes an appropriation.

RELATING TO REFERRAL TO ALCOHOL AND DRUG ABUSE SCREENING AND COUNSELING.

Requires a physician to offer to refer a patient being examined in a primary care or emergency room setting to alcohol and drug abuse screening and counseling when the physician has good reason to suspect substance abuse by the patient. Clarifies that patient may accept or refuse the offer.

RELATING TO HEALTH.

Requires recipients of state funding that provide information or offer programs regarding sex information to provide medically accurate, factual information that is age-appropriate and includes information on both abstinence and contraception.

RELATING TO SUN PROTECTION.

Establishes a sun protection program for students in public schools.

RELATING TO MINORS.

Allows a minor under certain circumstances to consent to the provision of medical care and services.

RELATING TO PERINATAL CARE.

Establishes funding for a pilot clinic to provide comprehensive prenatal, delivery, and postpartum care and social services on the island of Oahu to women who have a history of methamphetamine and other substance use.

RELATING TO SMOKE-FREE WORKPLACES.

Reduces exposure to secondhand tobacco smoke by establishing a smoke-free environment for state employees and for members of the public visiting or using state facilities in state buildings.

RELATING TO SMOKING.

Creates a new statewide smoking law and repeals current smoking law.

RELATING TO TORTS.

Lowers medical malpractice insurance premiums by adopting legislation that directly affects elements impacting medical malpractice insurance rates.

RELATING TO BOATING.

Increases mooring fees 50% on 7/1/06, and additional 10% each subsequent 7/1 for next 4 years.

RELATING TO SMALL BOAT HARBORS.

Raises the total aggregate value of capital advancement project contracts the board of land and natural resources may let per calendar year to improve small boat harbors from $5,000,000 to $25,000,000. Changes the maximum amount of a single capital advancement project contract that the board can execute without legislative approval from $2,000,000 to an unspecified amount.

RELATING TO THE GENERAL EXCISE TAX.

Requires 10% of GET revenues paid by owners of vessels used for commercial activities carried out in small boat harbors to be deposited each fiscal year into the boating special fund. Effective 7/1/2006.

RELATING TO COASTAL ZONE MANAGEMENT.

Expressly prohibits artificial lighting in all areas of the shoreline, including single-family districts and structures.

RELATING TO THE NATURAL AREA RESERVE SYSTEM.

Prohibits public vehicular access in Kaena Point natural area reserve.

MAKING AN APPROPRIATION TO ACQUIRE REAL PROPERTY IN WAHIAWA, OAHU.

Making an appropriation to acquire real property in Wahiawa, Oahu, underlying Lake Wilson.

RELATING TO THE STATE FISH.

Permanently establishes the humuhumunukunukuapua‘a (rhinecanthus rectangulus) as the official fish of the State.

RELATING TO WATER RESOURCES.

Prohibits the use of potable water for irrigation purposes on golf courses constructed after 1/1/07.
