RELATING TO FIREARMS, AMMUNITION, AND DANGEROUS WEAPONS.

Proposed HD1: Repeals prohibition against manufacture, possession, sale, barter, trade, gift, transfer, or acquisition of detachable ammunition magazines with a capacity in excess of ten rounds.

RELATING TO CHAPTER 134.

Amends chapter 134 to comply with certain provisions of the federal law contained in the "Brady Bill" by: (1) reflecting the current federal requirement that state firearms registration records include place of birth, country of citizenship, and for non-citizens, an alien or admission number; (2) reflecting the federal mandate that the national instant criminal background check system and the immigration and customs enforcement databases be checked prior to the issuance of firearms permits; (3) prohibiting a person's possession of firearms under state law if the person is prohibited from possessing firearms under federal law. RELATING TO BIOLOGICAL EVIDENCE.

Provides for the immediate DNA testing of all felons who are currently incarcerated. Allows for post conviction DNA testing for those who were not convicted but were acquitted of a crime on the ground of physical or mental disease, disorder, or defect. (SD1)

RELATING TO THE BACKLOG IN UNSERVED ARREST WARRANTS.

Authorizes service of warrants by retired police and public safety officers to assist in reducing the backlog of unserved arrest warrants. Provides for a sunset date of July 1, 2011. (SD1)

RELATING TO PRINCIPAL PRIVATE DETECTIVES AND GUARDS.

Repeals the requirement that principal detectives and principal guards must be residents of the State to qualify for licensure. Codifies the policy of allowing out-of-state principal detectives and principal guards to be licensed, provided they are fully responsible for the direct management and control of the agency and the agency's employees when detective services are being provided in the State. Allows an agency to emply more than one principal detective or principal guard.

RELATING TO DISASTER PREPAREDNESS.

Establishes Civil Defense Disaster Preparedness Special Fund and makes appropriation to the fund; requires Department of Defense to develop disaster preparedness emergency shelter plan and to report to Legislature; requires hospitals, nursing homes, and hotels to develop disaster preparedness plans; requires Department of Health to conduct a study of the structural integrity of hospitals and nursing homes in Hawaii; requires counties to locate, designate, and maintain areas to provide emergency shelter for homeless; establishes rebuttable presumption in favor of undergrounding electric utilities in tsunami-prone areas; authorizes Governor to expend funds from the emergency and budget reserve fund to provide emergency assistance to residents and businesses of the State after natural disaster; establishes the Residential Disaster Special Assistance Fund; limits the percentage of National Guard that can be activated by Governor for purposes other than disaster relief; establishes class C felony and misdemeanor offenses for price gouging and profiteering after natural disaster.
