Creates a class C felony criminal property damage offense for setting brush fires. Permits court to assess defendant for cost of fighting fire. Makes parent or guardian liable for the cost of extinguishing the fire based upon the percentage of damage done by the minor. (SD1)

RELATING TO FIRE PROTECTION.

RELATING TO CRIMINAL HISTORY RECORD INFORMATION.

Adds definitions for "criminal history record check" and "criminal history record name inquiry." Updates the fee schedule for criminal history record check services to include criminal history record checks done via the Internet. Extends the fee exemption to include nonprofit charitable organizations' adult volunteers having direct contact with the elderly and disabled. (SD1)

RELATING TO CHILD ABUSE.

Adds deputy sheriffs and narcotics enforcement officers of the department of public safety to those who must report child abuse cases and who have the authority to take a victim of child abuse into protective custody. Effective 7/1/2010. (HD1)

RELATING TO CHILD PASSENGER SAFETY.

Requires child safety seat or booster seat usage for children over four years by less than eight years old; defines "restrained". (SD1)

RELATING TO INTOXICATING LIQUOR VIOLATIONS INVOLVING MINORS.

Requires judges to suspend for 180 days the driver's licenses of licensed drivers under the age of 21 when the drivers have been convicted of illegal possession of liquor and if the defendant does not yet have driver's license, to postpone eligibility until the defendant is 17 years of age or for 180 days, whichever period is longer. Allows a judge the discretion to permit limited driving for those with a suspended license for employment or educational purposes. (SB706 HD1)

Gives law enforcement officers authority to enter premises and impound an animal when there is probable cause to believe the animal is being subjected to cruel treatment. Allows court to order the forfeiture of impounded animal prior to a criminal action against its owner.

RELATING TO GOVERNMENT.

Establishes a task force for the purpose of reviewing the scope, procedures, compliance with and enforcement of Chapter 92, Hawaii Revised Statues (the "Sunshine Law").

Repeals State's electronic surveillance statute and conforms the State's electronic surveillance laws to federal laws; regulates oral, electronic, and wire communications surveillance and interception; sets procedures for surveillance and interception. (SD2)
