RELATING TO HEALTH.

Increases tax per cigarette to 9 cents after 1/1/2007, 11 cents after 1/1/2008, and 13 cents after 1/1/2009. Earmarks 50% of tax to Cancer Research Center, 25% to DOH health promotion and disease prevention programs, and 25% to the Hawaii tobacco prevention and control trust fund.

RELATING TO HEALTH.

Establishes a new chapter that protects the public health and welfare by prohibiting smoking in public places and places of employment, ensuring a consistent level of basic protections statewide from exposure to secondhand. Repeals chapter 328K.

Prohibits smoking in all areas of state airports.

RELATING TO CRIMINAL OFFENSES BY MINORS.

Makes it an offense for any minor under the age of 18 to use any tobacco product. Makes it an offense to create or use a deceptive identification document for use by a minor to purchase tobacco or enter an age-restricted establishment.

RELATING TO TOBACCO.

Makes it a misdemeanor for minors (persons under age 18) to possess or use tobacco products. Exempts minors when lawfully delivering tobacco products or participating in a law enforcement activity.

RELATING TO NURSE AIDES.

Establishes certification procedures for nurse aides employed in facilities other than medicare/medicaid facilities.

RELATING TO NURSES.

Provides for the automatic forfeiture of a license that is not timely renewed. Provides for an inactive license status. Imposes a 2 year restoration period for forfeited (non-renewal) licenses. Adds continuing education as an alternative proof of continuing competence for nurses who wish to activate their licenses after not having practiced nursing in the US for more than 5 years.

RELATING TO MENTAL HEALTH COUNSELORS.

Amends the definition "practice of mental health counseling" to clarify that professional counseling services are determined by the specialized education, training, and experience that a practitioner completed.

Establishes a permanent community service license by repealing the sunset date.

RELATING TO DENTAL SPECIALISTS.

Authorizes the licensure by credentials of dental specialists who are licensed in another state.

RELATING TO THE HAWAII HEALTH SYSTEMS CORPORATION.

Alters composition and appointment of HHSC board membership by having the governor appoint 6 members – 3 each from a list of 9 candidates submitted by the president of the senate and speaker of the house of representatives, respectively, for a total 18 candidates for 6 member positions.
