RELATING TO IDENTITY THEFT.

Prohibits mailing of unsolicited credit card offers. Makes possession of another's mail with intent to commit identity theft a class C felony.

RELATING TO DESTRUCTION OF PERSONAL INFORMATION RECORDS.

Requires businesses that maintain or possess personal information of Hawaii residents to protect against unauthorized access to or use of the information after its disposal by destroying the personal information.

RELATING TO SOCIAL SECURITY NUMBER PROTECTION.

Requires businesses, subject to limited exceptions, from disclosing an individual's social security number to the general public; printing the SSN on an identification card or in mailings to customers; and requiring the transmission of a SSN to third parties without the individual's written consent unless the third party needs the information for a legitimate purpose.

RELATING TO IDENTITY THEFT.

Includes in the offense of identity theft in the third degree the unauthorized possession of confidential personal information. Adds identity theft in the first degree, identity theft in the second degree and identity theft in the third degree to the list of repeatable offenses for purpose of enhanced sentencing.

RELATING TO IDENTITY THEFT.

Prohibits posing as the holder of a cellular phone service account to obtain calling records. Prohibits sale or purchase of such records.

RELATING TO IDENTITY THEFT.

Requires persons, business, or government agencies who maintain personal information in computerized form to notify persons to whom the information relates of a breach of the security of the information. Authorizes attorney general to take legal action to enforce notice requirement.

RELATING TO ELECTRONIC COMMERCE.

Changes name of task force, expands its responsibilities, and extends its life until 6/30/07. Adds the chief justice or designee, and representatives from each county police department, the Hawaii Prosecuting Attorneys' Association, and the U.S. Postal Service to the task force membership.

RELATING TO THE USE OF SOCIAL SECURITY NUMBERS.

Lowers risk of identity theft by prohibiting collection or use of social security numbers by state or county agencies except as allowed by the federal Privacy Act.

RELATING TO CONSUMER CREDIT REPORTING AGENCIES.

Allows the victims of identity theft to place a "security freeze" on their credit reports prohibiting a credit reporting agency from releasing information without the consumer's express consent. Effective date 7/1/06.
