STAND. COM. REP. NO. 646

Honolulu, Hawaii

, 2005

RE: H.B. No. 564

H.D. 1

Honorable Calvin K.Y. Say

Speaker, House of Representatives

Twenty-Third State Legislature

Regular Session of 2005

State of Hawaii

Sir:

Your Committee on Judiciary, to which was referred H.B. No. 564 entitled:

"A BILL FOR AN ACT MAKING APPROPRIATIONS FOR CLAIMS AGAINST THE STATE, ITS OFFICERS, OR ITS EMPLOYEES,"

begs leave to report as follows:

The purpose of this bill is to provide for the authorization and payment of claims against the State for:

(1) Refunds of taxes;

(2) Judgments and settlements; and

(3) Other miscellaneous payments.

The Attorney General's Office testified in support of the bill.

This bill contains 12 claims totaling $622,563.86.

Your Committee finds that this bill will satisfy the claims against the State, its officers, or its employees, including claims for legislative relief, judgments against the State, settlements, and miscellaneous claims.

Your Committee has amended this bill by:

(1) Removing a duplicate reference to "Harnik v. State of Hawaii"; and

(2) Making technical, nonsubstantive changes for style, clarity, and consistency.

As affirmed by the record of votes of the members of your Committee on Judiciary that is attached to this report, your Committee is in accord with the intent and purpose of H.B. No.

564, as amended herein, and recommends that it pass Second Reading in the form attached hereto as H.B. No. 564, H.D. 1, and be referred to the Committee on Finance.

Respectfully submitted on behalf of the members of the Committee on Judiciary,
