SENATE RESOLUTION

 

STATING THE INTENT OF THE Legislature REGARDING the effective date of HOUSE BILL No. 2043, HOUSE DRAFT 2, SENATE DRAFT 3, CONFERENCE DRAFT 1.

 

WHEREAS, the Committee on Conference for House Bill No. 2043, House Draft 2, Senate Draft 3, Conference Draft 1, Regular Session of 2006, clearly stated that the effective date of the agreed-upon Conference Draft be April 28, 2006; and

WHEREAS, the Conference Draft was inadvertently made effective upon its approval; and

WHEREAS, this error does not reflect the Legislature's intent and purpose in regard to the bill; and

WHEREAS, this oversight potentially could harm a large number of Hawaii's QUEST beneficiaries; and

WHEREAS, there are insufficient legislative days remaining to correct the effective date; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, that it is the intent of the Legislature that, upon becoming an act, the application of House Bill No. 2043, House Draft 2, Senate Draft 3, Conference Draft 1, Regular Session of 2006, shall be effective retroactively to April 28, 2006; and

BE IT FURTHER RESOLVED that any Requests for Proposal that the Department of Human Services may issue prior to the effective date of House Bill No. 2043, House Draft 2, Senate Draft 3, Conference Draft 1, Regular Session of 2006, should be amended to comply with these measures; and

BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor and the Director of Human Services.
