SENATE CONCURRENT

RESOLUTION

 

requiring the legislative reference bureau to study the crime rates in jurisdictions in the United States that allow for the open carry of a firearm.

 

WHEREAS, during the 2006 legislative session, the Senate Committee on Judiciary and Hawaiian Affairs held a public hearing on S.B. No. 2529, Relating to Open Carry License of Firearms; and

WHEREAS, the measure authorized the chiefs of police to issue licenses to persons to openly carry a firearm and to prohibit openly carrying a firearm under certain circumstances; and

WHEREAS, during the public hearing on this measure, the Committee on Judiciary and Hawaiian Affairs received conflicting testimony on whether the crime rates in jurisdictions which allow the open carry of firearms were lower or higher as a result of such legislation; and

WHEREAS, due to the conflicting testimony, the Committee on Judiciary and Hawaiian Affairs determined that this issue would require further examination before a change in the law should be made; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the House of Representatives concurring, that the Legislative Reference Bureau shall conduct a study to:

(1) Compare and contrast the crime rates of jurisdictions in the United States that allow for the open carry of firearms;

(2) Examine what effect, if any, open carry legislation has had on reducing or increasing crime rates in these jurisdictions; and

(3) Extrapolate, to the extent possible, the impact of open carry legislation in Hawaii; and

BE IT FURTHER RESOLVED that the Legislative Reference Bureau shall provide the Legislature with a copy of its findings, conclusions, recommendations, and proposed legislation, if any, at least twenty days prior to the convening of the Regular Session of 2007; and

BE IT FURTHER RESOLVED that a certified copy of this Concurrent Resolution be transmitted to the Acting Director of the Legislative Reference Bureau.
