RESOLUTION
REQUESTING THE CLERK OF THE SENATE AND THE CLERK OF THE HOUSE of the Hawaii State Legislature TO POST INTERNAL ACCOUNTING INFORMATION ON THE INTERNET SITES OF THE RESPECTIVE HOUSES.
WHEREAS, section 92F-2, Hawaii Revised Statutes, relating to the Uniform Information Practices Act, states in pertinent part:
In a democracy, the people are vested with the ultimate decision-making power. Government agencies exist to aid the people in the formation and conduct of public policy. Opening up the government processes to public scrutiny and participation is the only viable and reasonable method of protecting the public's interest. Therefore the legislature declares that it is the policy of this State that the formation and conduct of public policy--the discussions, deliberations, decisions, and action of government agencies--shall be conducted as openly as possible;
and
WHEREAS, the business of the Legislature is the business of the public; and
WHEREAS, the public has a right to know how the Legislature is conducting the public's business; and
WHEREAS, the public can only know how well the Legislature conducts its business if there is transparency in government records, like all other state and county agencies; and
WHEREAS, internal accounting information of the Senate and the House are integral components of public information about which the public has a right to know; and
WHEREAS, chapter 92F contains no exemption for the Legislature; and
WHEREAS, accounting information of the Legislature should be open to public access in accordance with chapter 92F; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the House of Representatives concurring, that the Clerk of the Senate and the Clerk of the House of Representatives of the Hawaii State Legislature are requested to post internal accounting information on the Internet sites of the respective Houses, to the extent such information is public under chapter 92F, Hawaii Revised Statutes; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to Clerk of the Senate and the Clerk of the House of Representatives of the Hawaii State Legislature.
