SENATE CONCURRENT

RESOLUTION

 

REQUESTING THE DEPARTMENT OF EDUCATION AND THE DEPARTMENT OF HEALTH TO REPORT TO THE LEGISLATURE ON THE STATUS OF THE PARTS B AND C FORMULA GRANT AWARD APPLICATION PACKAGES FOR 2006 UNDER THE INDIVIDUALS WITH DISABILITIES EDUCATION ACT.

 

WHEREAS, Title 20 United States Constitution section 1400 provides that the Secretary of Education fund to the states under the Individuals with Disabilities Act to improve delivery of services under the program, including acquiring appropriate equipment, construction of new facilities or alteration of existing facilities, or providing special education and related services to children with disabilities in rural areas, and the Secretary is authorized to allow the use of those funds for construction of new facilities or alteration of existing facilities for those purposes; and

WHEREAS, federal funding will be available beginning July 1, 2006, but states must make application for funding on or before April 21, 2006; and

WHEREAS, the application for federal funds must lay out a state's plan for satisfying the requirements under the Individuals with Disabilities Act; and

WHEREAS, the Department of Education has jurisdiction in Hawaii for implementing the Individuals with Disabilities Act; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the House of Representatives concurring, that the Department of Education is urged to apply for these grant award packages; and

BE IT FURTHER RESOLVED as the Department of Education is requested to report to the Legislature no later than twenty days prior to the convening of the Regular Session of 2007 on its progress in making application for federal funding part B (all children with disabilities) formula grant award application packages for 2006 under the individuals with disabilities education act and for part C (infants and toddlers at risk for developmental delay) formula grant award application packages for 2006 under the Individuals with Disabilities Education Act; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Superintendent of Education and the Director of Health.
