RESOLUTION
requesting the judiciary to post on the internet financial disclosure statements of justices and judges.
WHEREAS, the Commission on Judicial Conduct was established by the Supreme Court of Hawaii to investigate allegations of judicial misconduct and disability, and has jurisdiction over all justices and judges of the State; and
WHEREAS, all justices and judges are required to abide by the Code of Judicial Conduct and must conduct their extra-judicial activities so as to minimize the risk of conflict with their judicial obligations; and
WHEREAS, under Canon 4, Revised Code of Judicial Conduct, all justices and judges must disclose their income, debts, investments, and other assets, and must file a financial disclosure statement with the Commission on Judicial Conduct; and
WHEREAS, the financial disclosure statements of justices and judges are public records that may be reviewed by persons who travel to the State Judiciary building in downtown Honolulu and reveal their identity to judiciary officials; and
WHEREAS, the Hawaii State Ethics Commission currently posts on its internet website the financial disclosure statements of all legislators, elected state officials, and appointed state officials, which gives the public easy access to statements via the Internet without having to identify themselves; and
WHEREAS, the Judiciary has the authority and responsibility to protect the privacy rights and interests of justices and judges by redaction of personal information from their financial disclosure statements; now, therefore,
BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the House of Representatives concurring, that the Judiciary is requested to post on the Internet all financial disclosure statements of justices and judges with all personal information redacted; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chief Justice of the Supreme Court of Hawaii, the Administrative Director of the Judiciary, and the Chair of the Commission on Judicial Conduct.
