SENATE CONCURRENT

RESOLUTION

 

URGING either the department of land and natural resources or the department of transportation to acquire the hanalei boatyard adjacent to the state pier and wharf facility and boat launch ramp at hanalei, kauai.

 

WHEREAS, Hanalei River and Bay are part of the oldest commercial harbor on Kauai, and King Kamehameha III designated the area as a treaty port with the United States in 1849; and

WHEREAS, the State has all facilities necessary to continue commercial boat operations out of this state harbor, including pier, wharf, and boat ramp and launch, but does not have parking or restroom facilities; and

WHEREAS, the State has encouraged a private landowner to build these facilities, with the understanding that the State would either lease or acquire by outright purchase or land exchange those private boatyard improvements; and

WHEREAS, the State has yet to do so, and also has no rules that regulate commercial tour operations at Hanalei; now, therefore,

BE IT RESOLVED by the Senate of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the House of Representatives concurring, that the Department of Land and Natural Resources or the Department of Transportation, whichever has appropriate jurisdiction, is urged to enter into meaningful negotiations with the private boatyard owner to acquire the facilities on the Hanalei River and to begin creating rules to incorporate them into the state boating operations; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Chairperson of the

Board of Land and Natural Resources and the Director of Transportation.
