A BILL FOR AN ACT

 

RELATING TO HIGHWAY SAFETY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 286-108.4, Hawaii Revised Statutes, is amended to read as follows:

"[[]§286-108.4 Driver education and behind-the-wheel driver training program.[]] (a) The director of transportation [is directed to] shall establish and certify a statewide driver education program and behind-the-wheel driver training program, to include the number of course hours, curriculum, and certification of teachers and third-party examiners. The director of transportation [is also directed to] shall set a cost in accordance with subsection (b) for the programs to enable the programs to be self-sufficient. The director of transportation shall adopt rules pursuant to chapter 91 necessary for the purposes of this [[]section[]].

(b) No private person or entity shall charge more than the following amounts in each county for a driver education and behind-the-wheel driver training program under subsection (a) for each series of lessons:

City and county of Honolulu $_________

County of Kauai $_________

County of Maui $_________

County of Hawaii $_________"

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall not affect driver education and behind-the-wheel driver training programs paid for before the effective date of this Act.

SECTION 4. This Act shall take effect upon its approval.
