A BILL FOR AN ACT
relating to public order.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 711, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§711- Human consumption of or trafficking in dog or cat meat. (1) A person commits the offense of human consumption of or trafficking in dog or cat meat if the person intentionally:
(a) Causes, by the person's self or in conspiracy with another, the death of a dog or cat for the purpose of human consumption;
(b) Sells, exchanges, trades, or barters dog or cat meat;
(c) Purchases dog or cat meat;
(d) Consumes dog or cat meat;
(e) Possesses dog or cat meat; provided that this paragraph shall not apply to a pet owner, pet cemetery, or pet crematory that possesses a dead dog or cat for the purposes of burial or cremation; or
(f) Transfers to or receives from another person dog or cat meat.
(2) As used in this section:
"Dog or cat meat" means the carcass of a dog or cat.
"Sells" means to transfer to another for consideration.
(3) Violation of this section shall be a misdemeanor."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
