Description:

Allows an elective officer who attains the age of sixty-five to retire and receive a service retirement allowance while continuing to fill an elective position; provided that the elective officer has continuously served in the state legislature as an elective officer for at least twenty years immediately prior to retiring. A BILL FOR AN ACT

 

relating to the employees' retirement system.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 88-73, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

"(d) Any [member of the legislature] elective officer who attains age sixty-five may retire and receive a service retirement allowance although the [member] elective officer continues to fill the elective position[.]; provided that this subsection shall only apply to an elective officer who has continuously served in the state legislature as an elective officer for at least twenty years immediately prior to retiring under this subsection."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect on July 1, 2050.
