A BILL FOR AN ACT

 

relating to marriage.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that too many couples enter a marriage without a realistic idea of parenting and its challenges. The legislature further finds that there is a lack of resources available to educate the public on family law proceedings, specifically the divorce litigation process, and the benefits of alternative dispute resolution processes in such matters.

The purpose of this Act is to require the department of health to provide couples entering into a marriage with information regarding parenting information, including parenting and communication skills, domestic violence, and the divorce litigation process, including the benefits of alternative dispute resolution.

SECTION 2. Section 572-5, Hawaii Revised Statutes, is amended by amending subsection (d) to read as follows:

"(d) The department or its authorized agents shall furnish to each applicant for a marriage license a brochure explaining rubella, the risks of infection with rubella during pregnancy, and how to seek testing and immunization. The department or its authorized agents shall also furnish to each applicant for a marriage license information, to be provided by the department, relating to parenting, population stabilization, family planning, birth control, the divorce litigation process, including the availability and benefit of alternative dispute resolution processes, domestic violence, fetal alcohol and drug syndromes, and acquired immune deficiency syndrome (AIDS), including the availability of anonymous testing for human immunodeficiency virus (HIV) infection at alternate test sites; provided that such information is available."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect upon its approval.
