A BILL FOR AN ACT
making an APPROPRIATION for EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to establish a weighted student formula conversion program to provide supplementary funds for schools that are adversely affected by the weighted student formula established pursuant to Act 51, Session Laws of Hawaii 2004.
SECTION 2. There is established in the department of education a weighted student formula conversion program for the purpose of disbursing funds to qualified public schools that are adversely affected by the weighted student formula established pursuant to Act 51, Session Laws of Hawaii 2004. The weighted student formula conversion program shall be administered by the department of education, which shall create program guidelines; provided that:
(1) Only schools that experience a reduced level of funding due to the implementation of the weighted school formula may apply for program funds;
(2) Program moneys shall be used for the purpose of maximizing student achievement through enhancing educational outcomes noted in Act 51, Session Laws of Hawaii 2004, and shall be expended to support activities as outlined in the school's strategic plan and academic and financial plan; and
(3) A school, at the discretion of the superintendent of education, may receive these moneys for not more than three years beginning with the 2006-2007 school year, provided that the school demonstrates:
(A) Adequate yearly progress as defined by the federal No Child Left Behind Act of 2001;
(B) Sufficient growth or progress toward meeting adequate yearly progress; or
(C) Compliance with the department's weighted school formula conversion personnel management plan.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $3,000,000, or so much thereof as may be necessary for fiscal year 2006-2007, to support schools adversely affected by the conversion to the weighted student formula.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $20,000,000, or so much thereof as may be necessary for fiscal year 2006-2007, for the purpose of establishing a weighted school formula conversion program in the department of education to provide supplementary funds to schools that are adversely affected by the weighted student formula established pursuant to Act 51, Session Laws of Hawaii 2004.
SECTION 5. The sums appropriated shall be expended by the department of education for the purposes of this Act.
SECTION 6. This Act shall take effect on July 1, 2006.
