A BILL FOR AN ACT
making an APPROPRIATION for EDUCATION.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
PART I
SECTION 1. Act 51, Session Laws of Hawaii 2004, also known as the Reinventing Education Act of 2004, instituted a new method of educational funding under the weighted student formula, which departed radically from the previous method of funds allocation based on school enrollment. However, such substantial change can cause some uncertainty and discomfort during the transitional period.
Therefore, the purpose of this part is to establish a weighted student formula conversion program to provide supplementary funds to help ease schools' transition into the new spending method under the weighted student formula. The legislature in no way intends for this appropriation of funds to represent a bailout and remains committed to ensuring the success of the weighted student formula.
SECTION 2. There is established in the department of education a weighted student formula conversion program for the purpose of disbursing supplementary funds to help public schools transition into the new spending method under the weighted student formula established pursuant to Act 51, Session Laws of Hawaii 2004. The weighted student formula conversion program shall be administered by the department of education, which shall create program guidelines; provided that:
(1) Only schools that experience a reduced level of funding due to the implementation of the weighted student formula may apply for program funds;
(2) Program moneys shall be used for the purpose of maximizing student achievement through enhancing educational outcomes noted in Act 51, Session Laws of Hawaii 2004, and shall be expended to support activities as outlined in the school's strategic plan and academic and financial plan; and
(3) A school, at the discretion of the superintendent of education, may receive these moneys for not more than three years beginning with the 2006-2007 school year; provided that the school demonstrates:
(A) Adequate yearly progress as defined by the federal No Child Left Behind Act of 2001;
(B) Sufficient growth or progress toward meeting adequate yearly progress as determined by the superintendent of education; or
(C) Compliance with the department's weighted student formula conversion personnel management plan.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $20,000,000 or so much thereof as may be necessary for fiscal year 2006-2007 to help ease schools' transition into the new spending method under the weighted student formula.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2006-2007 for the purpose of establishing a weighted student formula conversion program in the department of education to provide supplementary funds to help ease schools' transition into the new spending method under the weighted student formula established pursuant to Act 51, Session Laws of Hawaii 2004.
SECTION 5. The sums appropriated shall be expended by the department of education for the purposes of this part.
PART II
SECTION 6. The purpose of this part is to ensure that public schools receive the funds they need to provide quality education to our students. Specifically, this part appropriates funds for:
(1) Classroom supplies;
(2) Textbooks;
(3) Resources that will guide students on their path to higher education;
(4) Special education needs;
(5) English as a second language services; and
(6) Information technology needs.
SECTION 7. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,400,000 or so much thereof as may be necessary for fiscal year 2006-2007 to provide $200 debit cards to each of twelve thousand teachers to purchase classroom supplies.
SECTION 8. There is appropriated out of the general revenues of the State of Hawaii the sum of $2,000,000 or so much thereof as may be necessary for fiscal year 2006-2007 for science textbooks and classroom science equipment.
SECTION 9. There is appropriated out of the general revenues of the State of Hawaii the sum of $175,000 or so much thereof as may be necessary for fiscal year 2006-2007 for Preliminary SAT testing for all tenth graders.
SECTION 10. There is appropriated out of the general revenues of the State of Hawaii the sum of $500,000 or so much thereof as may be necessary for fiscal year 2006-2007 for advanced placement teacher training, test costs, and classroom materials.
SECTION 11. There is appropriated out of the general revenues of the State of Hawaii the sum of $17,295,867 or so much thereof as may be necessary for fiscal year 2006-2007 for special education needs, including for occupational therapists, physical therapists, special education teachers, speech language pathologists, nursing for the medically fragile, and school-based behavioral health services.
SECTION 12. There is appropriated out of the general revenues of the State of Hawaii the sum of $5,000,000 or so much thereof as may be necessary for fiscal year 2006-2007 for information technology to help the department of education streamline and raise the automation level of its key operational processes.
SECTION 13. There is appropriated out of the general revenues of the State of Hawaii the sum of $1,193,669 or so much thereof as may be necessary for fiscal year 2006-2007 for English as a second language services, including instruction, transitional bilingual support, and multicultural educational services.
SECTION 14. Sums appropriated under this part shall be in addition to any other funds that may be appropriated for the same purposes.
SECTION 15. The sums appropriated shall be expended by the department of education for the purposes of this part.
SECTION 16. This Act shall take effect on July 1, 2020.
