A BILL FOR AN ACT

 

RELATING TO THE STATE BUDGET.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 37, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:

"§37-   Federal mandates; duty to report. (a) For purposes of preparation and evaluation of the executive budget, the department of budget and finance shall submit a report of all unfunded federal mandates to the governor, the legislature, and Hawaii's congressional delegation no later than sixty days prior to the convening of each regular session. The report shall delineate every unfunded mandate. Each report shall be cumulative from the previous report and shall include:

(1) New unfunded mandates enacted by Congress since the last report;

(2) A description of each unfunded mandate, including the costs to the State and identification of the particular department charged with implementing the mandate;

(3) The status of each unfunded mandate with regard to state implementation;

(4) An explanation of the impact of each unfunded mandate on state revenues; and

(5) A statement of the unfunded mandates that have lapsed since the last report.

(b) As used in this section:

"Federal mandate" shall have the same meaning as in Title 2, United States Code, section 1555, as amended, as applied to the State.

"Unfunded mandate" means a requirement imposed by Congress on the State without funding to pay for it."

SECTION 2. New statutory material is underscored.

SECTION 3. The first report pursuant to section 1 of this Act shall be due not less than sixty days prior to the convening of the regular session of 2007.

SECTION 4. This Act shall take effect upon its approval.
