A BILL FOR AN ACT

 

RELATING TO AGRICULTURE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that the down-sizing of the sugar and pineapple industries are leaving vast acres of arable land, irrigation water, and agricultural infrastructure available for new and more diverse agricultural ventures. To meet this challenge, the legislature created the agribusiness development corporation.

The purpose of this Act is to direct the office of planning to create an action plan to:

(1) Transfer many of the responsibilities of the board of agriculture and the department of agriculture to the agribusiness development corporation and to the department of business, economic development, and tourism; and

(2) Transfer the agribusiness development corporation from the department of agriculture to the department of business, economic development, and tourism for administrative purposes.

SECTION 2. The office of planning is directed to develop an action plan for the transfer of the following responsibilities:

(1) From the board of agriculture and the department of agriculture to the agribusiness development corporation:

(A) The development and management of irrigation systems, pursuant to chapter 167, Hawaii Revised Statutes;

(B) The development and management of irrigation and water utilization projects, pursuant to chapter 168, Hawaii Revised Statutes;

(C) The development and management of agricultural parks, pursuant to chapter 166, Hawaii Revised Statutes;

(D) The development and management of non-agricultural park land, pursuant to chapter 166E, Hawaii Revised Statutes;

(E) The operation of the agricultural loan programs, pursuant to chapter 155, Hawaii Revised Statutes;

(F) The agricultural processing, grading, and standards responsibilities, pursuant to chapters 145 and 147, Hawaii Revised Statutes; and

(G) The implementation and oversight of the Milk Control Act and the Hawaii Meat Inspection Act, pursuant to chapters 157 and 159, Hawaii Revised Statutes, respectively; and

(2) From the board of agriculture and department of agriculture to the department of business, economic development, and tourism, all advertising and marketing responsibilities, pursuant to chapter 148, Hawaii Revised Statutes.

SECTION 3. The office of planning shall include in the action plan the transfer of the agribusiness development corporation from the department of agriculture to the department of business, economic development, and tourism for administrative purposes.

SECTION 4. The office of planning shall submit the action plan set forth in sections 2 and 3, along with any proposed legislation necessary to implement the action plan, to the legislature not less than twenty days before the convening of the regular session of 2007.

SECTION 5. This Act shall take effect upon its approval.
