A BILL FOR AN ACT
RELATING TO PREVAILING WAGES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 104, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:
"§104- Indirect public works project; prevailing wages certification; compliance. (a) Prior to the start of construction on any indirect public works project, the construction project owner who undertakes the indirect public works project shall sign a lease or other agreement with the State, county, or any agency of the State or county that includes provisions that require:
(1) Compliance with this chapter; and
(2) Certification that prevailing wages shall be paid as established under this chapter.
Copies of the lease or other agreement shall be filed with the department of labor and industrial relations and the department of accounting and general services. The construction project owner shall submit certified payrolls to the department of accounting and general services.
(b) For purposes of this section, "indirect public works project" means any project, including development of any housing pursuant to section 46-15 or chapter 201G, development, construction, renovation, and maintenance related to refurbishment of any real or personal property that has or will receive a government benefit, including a construction contract between private persons if more than twenty-five per cent of the assignable square feet of the project or property is leased for use by the State, any county, or any agency of the State or any county for its use, whether or not the property is privately owned and either:
(1) The lease agreement is entered into prior to the construction contract becoming effective; or
(2) Construction work is performed according to a plan, specifications, or criteria established by the State, any county, or any agency of the State or any county."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
