A BILL FOR AN ACT
RELATING TO PUBLIC PARKING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that the Kapahulu district on Oahu is a densely populated area of residential dwellings and small businesses. Parking is in short supply. Other than street parking, there are no parking structures in Kapahulu. Small businesses are being adversely affected by the lack of a parking structure.
The legislature further finds that the department of land and natural resources is currently seeking rezoning of certain state property along Kapahulu Avenue for a long-term commercial lease.
The purpose of this Act is to make an appropriation to construct a parking facility along Kapahulu Avenue and to lease the parking lot to the city and county of Honolulu to operate.
SECTION 2. The department of land and natural resources shall construct a parking facility along Kapahulu avenue, on Oahu, to be located on property identified as TMK numbers 2-7-36:04 and 2-7-36:16. The parking facility shall be leased on a long-term basis to the city and county of Honolulu to operate the parking facility, with lease rent to be determined by the department of land and natural resources; provided that the amount of the lease may be a nominal amount in consideration of the public nature of the parking facility.
SECTION 3. There is appropriated out of the general revenues of the State of Hawaii the sum of $300,000, or so much thereof as may be necessary for fiscal year 2006-2007, for construction of a parking facility on Kapahulu Avenue (TMK 2-7-36:04 and 16), in accordance with section 2 of this Act.
SECTION 4. The sum appropriated shall be expended by the department of land and natural resources for the purposes of this Act.
SECTION 5. This Act shall take effect on July 1, 2006.
