A BILL FOR AN ACT

 

relating to the courts.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to require the circuit and district courts to be open for extended hours to, among other things, process arrest warrants and ease the burden on the State's jails by allowing persons to be arraigned shortly after their arrest.

SECTION 2. Chapter 603, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§603-   Extended court hours. (a) Effective January 1, 2007, the circuit courts shall be required to be open to conduct judicial business during the following extended hours:

(1) The first judicial circuit shall be open:

(A) Six o'clock p.m. to 12:00 midnight, Monday through Friday, excluding state holidays as designated in section 8-1; and

(B) Nine o'clock a.m. to four o'clock p.m. on Saturdays.

(2) The circuit courts of the second, third, and fifth circuits shall be open:

(A) Six o'clock p.m. to 12:00 midnight at least three days per week, excluding state holidays as designated in section 8-1; and

(B) Nine o'clock a.m. to four o'clock p.m. on Saturdays.

(b) During the extended court hours, the circuit courts shall process arrest warrants and conduct any other business deemed necessary."

SECTION 3. Chapter 604, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§604-   Extended court hours. (a) Effective January 1, 2007, the district courts shall be open to conduct judicial business during the following extended hours:

(1) The district court of the first circuit shall be open:

(A) Six o'clock p.m. to 12:00 midnight, Monday through Friday, excluding state holidays as designated in section 8-1; and

(B) Nine o'clock a.m. to four o'clock p.m. on Saturdays.

(2) The district courts of the second, third, and fifth circuits shall be open the following extended hours:

(A) Six o'clock p.m. to 12:00 midnight at least three days per week, excluding state holidays as designated in section 8-1; and

(B) Nine o'clock a.m. to four o'clock p.m. on Saturdays.

(b) During the extended court hours, the district courts shall process arrest warrants and conduct any other business deemed necessary."

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, to the judiciary for the purpose of facilitating the extended hours of the circuit and district courts. The sums appropriated shall be expended by the judiciary for the purposes of this Act.

SECTION 5. New statutory material is underscored.

SECTION 6. This Act shall take effect on July 1, 2006.
