A BILL FOR AN ACT
relating to shoreline determination.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 205A-1, Hawaii Revised Statutes, is amended by amending the definition of "shoreline" to read as follows:
""Shoreline" means the line of the upper reaches of the wash of the waves, other than storm and seismic waves, at high tide during the season of the year in which the highest wash of the waves occurs, usually evidenced by the edge of vegetation growth, or where there is no vegetation growth in the immediate vicinity, the upper limit of debris left by the wash of the waves."
SECTION 2. Chapter 205A, Hawaii Revised Statutes, is amended by adding a new section to part III to be appropriately designated and to read as follows:
"§205A- Factors for determination of shoreline. (a) In determining the location of the shoreline, the board of land and natural resources shall consider the following factors in determining the upper reaches of the wash of the waves:
(1) The upper limit of debris left by the wash of the waves; or
(2) The edge of vegetation growth,
whichever is further inland.
(b) For purposes of this section, the edge of the vegetation growth shall not be considered if there is any evidence that the vegetation growth was artificially extended by the planting and irrigation of salt-resistant vegetation."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
