A BILL FOR AN ACT
RELATING TO DRIVER'S LICENSING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The examiner of drivers can require a road test that measures a driver's functional ability to safely operate a motor vehicle. Only drivers with a valid license or instruction permit may take a road test. Applicants whose driving privilege is under review may not have a valid license or instruction permit after failing the road test on their first attempt.
The purpose of this Act is to provide the examiner of drivers with the authority to issue an instruction permit to allow this applicant the opportunity to practice driving while accompanied by a licensed driver and to make additional attempts to pass the road test for licensing.
SECTION 2. Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§286- Special temporary instruction permit. An applicant for a driver's license who undergoes and fails the actual demonstration of ability to operate a motor vehicle under section 286-108(a), if the demonstration was recommended by the medical advisory board pursuant to section 286-4.1, may be issued a special temporary instruction permit, upon the approval of the medical advisory board, entitling the applicant, while having the permit in the applicant's immediate possession, to drive a motor vehicle upon the highways for a period of one year. The holder of a special temporary instruction permit shall be accompanied by a licensed driver at all times while driving. Upon receipt of an updated medical report from the medical advisory board about the applicant, which indicates that the applicant has a prospect of obtaining a driver's license, the applicant may apply for renewal of the special temporary instruction permit for a period of ninety days."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
