A BILL FOR AN ACT

 

relating to recycling Programs.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§46-   Onsite recycling programs; new buildings. (a) Each county by ordinance shall develop a mandatory onsite recycling program for all buildings constructed on or after July 1, 2007. Under the program, new buildings shall be required to adhere to the county recycling plan, which may require onsite recycling facilities. Specifically, the program shall provide procedures for:

(1) The separation of the recyclable materials from other refuse;

(2) The collection of the recyclable materials; and

(3) The sale, recycling, or reuse of the recyclable materials.

(b) The mandatory onsite recycling plan shall not apply to an exempted building. For the purposes of this section, "exempted building" means:

(1) Any building owned or leased in whole or in part by the United States; and

(2) Any building constructed as a single family residential dwelling.

(c) Each county shall adopt any ordinance required by this section by July 1, 2007, and each county shall adopt rules pursuant to chapter 91 to implement this section."

SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, for a grant-in-aid to the city and county of Honolulu for implementing a mandatory onsite recycling program.

SECTION 3. The sum appropriated shall be expended by the city and county of Honolulu for the purposes of this Act.

SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, for a grant-in-aid to the county of Maui for implementing a mandatory onsite recycling program.

SECTION 5. The sum appropriated shall be expended by the county of Maui for the purposes of this Act.

SECTION 6. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, for a grant-in-aid to the county of Hawaii for implementing a mandatory onsite recycling program.

SECTION 7. The sum appropriated shall be expended by the county of Hawaii for the purposes of this Act.

SECTION 8. There is appropriated out of the general revenues of the State of Hawaii the sum of $          , or so much thereof as may be necessary for fiscal year 2006-2007, for a grant-in-aid to the county of Kauai for implementing a mandatory onsite recycling program.

SECTION 9. The sum appropriated shall be expended by the county of Kauai for the purposes of this Act.

SECTION 10. New statutory material is underscored.

SECTION 11. This Act shall take effect on July 1, 2006.
