A BILL FOR AN ACT
relating to recycling Programs.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 342G, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:
"§342G-A Voluntary recycling programs; existing buildings. (a) The department shall develop a voluntary onsite recycling program for all buildings constructed before July 1, 2007. Under the program, owners shall be encouraged to implement a voluntary onsite recycling plan for all existing buildings. The program shall provide for the:
(1) Separation of the recyclable materials from other refuse;
(2) Collection by the State of the recyclable materials; and
(3) Sale, recycling, or reuse of the recyclable materials.
(b) The department shall adopt rules pursuant to chapter 91 to implement this section.
§342-B Recycling program special fund. (a) There is established in the state treasury the recycling program special fund. All moneys collected pursuant to section 342G-A shall be deposited in the recycling program special fund. All interest earned or accrued on moneys deposited in the fund shall become a part of the fund.
(b) Moneys in the recycling program special fund shall be used to:
(1) Reimburse building owners or operators for recycling costs;
(2) Partially fund the operating costs of the program;
(3) Promote activities to develop a market for recyclables; and
(4) Fund administrative, audit, and compliance activities associated with collection and payment of the costs for the recycling program.
(c) The department shall adopt rules pursuant to chapter 91 to administer the recycling program special fund."
SECTION 2. In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
