A BILL FOR AN ACT

 

relating to community development.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 206E, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

"§206E- Kakaako central small business district; established and excluded from the Kakaako community development district. (a) Within the Kakaako community, there is established the Kakaako central small business district. The district shall include that area: makai of Kapiolani boulevard bordered by Cooke street in the west; turning east off Cooke street onto Auahi street; turning mauka off Auahi street onto Ward avenue; turning east off of Ward avenue onto Queen street; through the merging of Queen street with Waimanu street until Waimanu street's terminus at Piikoi street; turning mauka off Waimanu street onto Piikoi street until Piikoi street intersects with Kapiolani boulevard.

(b) Notwithstanding any law to the contrary, the city and county of Honolulu shall have jurisdiction over the Kakaako central small business district.

(c) Prior to establishing any master plan for, or planning, designing, expanding, or constructing any infrastructure within, the Kakaako central small business district, the city and county of Honolulu shall conduct at least one public hearing on the proposed master plan or infrastructure improvement within the Kakaako central small business district. The public hearing shall be conducted in accordance with chapter 92."

SECTION 2. Notwithstanding any law to the contrary, the Hawaii community development authority shall not plan, engage in, begin, or continue any capital improvement project within the Kakaako community development district as identified in section 206E-32, Hawaii Revised Statutes, as amended by section 1 of this Act, that involve any infrastructure construction or street improvements; provided that this moratorium shall not apply to any emergency capital improvement project that is required to repair any damage to infrastructure or a street caused by a natural disaster or act of god and necessary to safeguard the health and safety of the general public.

SECTION 3. On the effective date of this Act, the Hawaii community development authority shall transfer all necessary documents, deeds, leases, contracts, plans, and all other pertinent information regarding the Kakaako central small business district to the city and county of Honolulu.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval; provided that section 2 shall be repealed on January 1, 2007.
