A BILL FOR AN ACT

 

relating to medicaid.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§346-   Medicaid waiver application, requirements. The department may apply for waivers of applicable federal laws and regulations, after notice is provided to the legislature and the legislature's input is solicited as provided in subsection (b), as necessary to implement more appropriate systems of health care for medicaid recipients and reduce the cost of the medicaid program to the state and federal governments and shall implement the programs within a reasonable period of time after federal approval. These programs shall be designed primarily to reduce the need for inpatient care, custodial care and other long-term or institutional care, and other high-cost services.

(b) The notice specified in subsection (a) shall be provided within thirty to sixty days prior to any waiver submission, allowing the legislature to have adequate time to review and submit comments."

SECTION 2. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
