A BILL FOR AN ACT

 

relating to motor vehicles.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 437-1.1, Hawaii Revised Statutes, is amended by amending the definition of "motor vehicle" to read as follows:

""Motor vehicle" includes any vehicle, motor vehicle, or truck, as defined in sections 249-1 and 249-2, except for:

(1) Vehicles procured by a county agency for use in a public transit system or a transportion system for persons with disabilities; [tractors,]

(2) Tractors; [trailers,]

(3) Trailers; and [amphibious]

(4) Amphibious vehicles."

SECTION 2. Section 437-2, Hawaii Revised Statutes, is amended by amending subsection (e) to read as follows:

"(e) Notwithstanding any provisions of this chapter, the authority of any state or county agency to purchase motor vehicles for state or county use from any dealer licensed under this chapter shall not be limited or conditioned[.]; provided that a state or county may purchase public transit vehicles or vehicles used in a transportation system for persons with disabilities from a person who is not a licensed dealer under this chapter. Any dealer licensed under this chapter may sell vehicles to any state or county agency."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
