A BILL FOR AN ACT

 

relating to kaanapali beach.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that it is important to keep Kaanapali Beach in Maui safe and free from disorderly conduct. Police have responded to many calls regarding assaults, fights, and other disorderly conduct as a result of alcohol consumption after sunset at Kaanapali Beach.

The purpose of this section is to prohibit possession of an open container, or consumption, of alcoholic beverages at Kaanapali Beach after eight o'clock p.m.

SECTION 2. Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§281-   Consuming or possessing intoxicating liquor at Kaanapali Beach. (a) No person shall consume any intoxicating liquor at Kaanapali Beach after eight o'clock p.m.

(b) No person shall possess, while at Kaanapali Beach after eight o'clock p.m., any bottle, can, or other receptacle containing any intoxicating liquor which has been opened, has a seal broken, or the contents of which have been partially removed.

(c) Any person violating this section shall be guilty of a petty misdemeanor."

SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.

SECTION 4. New statutory material is underscored.

SECTION 5. This Act shall take effect upon its approval.
