A BILL FOR AN ACT
RELATING TO STATE EMPLOYEE LEGAL IDENTIFICATION CARDS.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this bill is to provide greater security in state buildings and offices by requiring that the department of accounting and general services issue legal identification cards to all state employees.
SECTION 2. Chapter 846, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:
"Part . STATE EMPLOYEE IDENTIFICATION CARDS
§846- Definition. As used in this part:
"Agency" shall mean all executive departments, boards, commissions, bureaus, offices, agencies, courts, committees and all other establishments of the state government.
"Employee" shall mean officers and employees of any state agency and persons acting in behalf of a state agency in an official capacity, whether permanently or temporarily, for compensation. This definition shall not include any contractor with the State.
"Department" shall mean the department of accounting and general services.
§846- Issuance. The department shall issue legal identification cards to all state employees.
§846- Information required. (a) Each legal identification card shall contain:
(1) A frontal photograph of the employee's face;
(2) The employee's legal name;
(3) The employee's date of birth;
(4) The name of the agency employer and the employee's business telephone number;
(5) The employee's physical description, including sex, height, weight, hair color, and eye color;
(6) The date of issuance; and
(7) The employee's signature.
(b) Any change in the information required under paragraphs (a)(2) and (a)(5) shall require that the employee be re-issued a legal identification card containing the updated information.
(c) The department shall be required to maintain a record of the information required under subsection (a).
§846- Display requirements. All employees shall be required to display the legal identification card issued to them on their person at all times while at any place of assigned state business or duty. This display requirement shall not apply to any elected state official, judges, or any appointed state official with a cabinet level rank.
§846- Effect of legal identification cards. The legal identification cards issued under this part, whether an original or a renewal, shall be considered an official state-issued identification card for all purposes for which a civil identification card under part III would be accepted.
§846- Expiration of legal identification cards. Every legal identification card issued under this part shall:
(1) Be renewed every three years after the date of issuance; and
(2) Expire on the termination of the employee's employment with the State. Employees shall be required to forfeit their legal identification cards upon the date of termination, whether willful or unwillful, of their employment with the State."
SECTION 3. This Act, upon approval, shall take effect on January 1, 2007.
