A BILL FOR AN ACT

 

RELATING TO STATEWIDE TRAFFIC CODE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Section 291C-76, Hawaii Revised Statutes, is amended to read as follows:

"§291C-76 Pedestrians on roadways[.]; crosswalk lighting. (a) Where sidewalks are provided it shall be unlawful for any pedestrian to walk along and upon an adjacent roadway, bicycle lane, or bicycle path.

(b) Where sidewalks are not provided any pedestrian walking along and upon a highway shall, when practicable, walk only on the left side of the roadway or its shoulder facing traffic which may approach from the opposite direction.

(c) The department of transportation shall ensure that each new crosswalk constructed after July 1, 2005 is equipped with adequate overhead street lighting to avoid, to the extent practicable, a collision between a driver of a motor vehicle and a pedestrian. The department shall develop a plan to install such lighting at all crosswalks, beginning with those subject to the most heavily used at night. This subsection shall not be construed to create a cause of action against the State or the department of transportation or their employees and agents."

SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.

SECTION 3. This Act shall take effect upon its approval.
