A BILL FOR AN ACT

 

RELATING TO STATE FUNDS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Temporary transit authority; establishment; membership; temporary transit special fund. (a) There is established the temporary transit authority, which shall administer the temporary transit special fund. The authority shall be placed within the department of transportation for administrative purposes.

(b) The temporary transit authority shall be governed by a seven-member board of directors. The members of the board of directors shall be appointed as follows:

(1) Four members, one from each county, shall be appointed by the respective mayors of the several counties;

(2) One member to be appointed by the governor;

(3) One member to be appointed by the president of the senate; and

(4) One member to be appointed by the speaker of the house of representatives.

Members shall select a chairperson from among the members of the board.

(c) The temporary transit authority shall have control of and administer moneys in the temporary transit special fund. The board shall allocate moneys from the temporary transit special fund in a proportionate manner to the counties for the counties' use for a mass transit system, in the case of the city and county of Honolulu, and for other public transit systems or county highways, in the case of the counties of Hawaii, Maui, and Kauai.

(d) The temporary transit authority shall cease to exist on July 1, 2008.

SECTION 2. Temporary transit special fund. (a) There is created within the state treasury the temporary transit special fund, which shall be administered by the temporary transit authority, and into which shall be deposited appropriations and transfers of moneys from the state highway fund.

(b) The temporary transit fund shall be repealed on July 1, 2008. Upon repeal of the fund, any remaining balance in the temporary transit fund shall be deposited into the state highway fund.

SECTION 3. The legislature determines that there is in the state highway fund at least $           in excess of the requirements of the fund. On July 1, 2005, the director of finance is authorized to transfer from the state highway fund to the temporary transit special fund the sum of $          , or so much thereof as may be necessary for fiscal year 2005-2006.

SECTION 4. This Act shall take effect upon approval and shall be repealed on July 1, 2008, except that section 3 shall take effect on June 30, 2005.
