A BILL FOR AN ACT

 

RELATING TO Consumer Protection.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

Section 1. The purpose of this Act is to ensure that the terms of a customer's health club contract with the seller of a health club is honored by a purchaser of the health club.

SECTION 2. Chapter 486N, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§486N-   Health club contracts upon sale of health club. Upon the sale of a health club, the purchaser of the health club shall assume all liabilities of the health club, including any liability arising under a contract entered into by the seller of the health club."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2050, provided that section 2 shall apply to all existing and prior contracts.
