A BILL FOR AN ACT
relating to public property.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that preservation of maritime industrial lands is paramount and more necessary than non-maritime commercial development.
The purpose of this Act is to preserve maritime lands for current and future needs of the State and ensure that the harbors division of the department of transportation controls the development of these lands to best serve the transportation needs of the people of Hawaii.
SECTION 2. The department of transportation is directed to operate, manage, and develop state lands that are within a radius of three thousand feet of a harbor pier or wharf and within a one thousand five hundred feet radius of an existing container yard.
SECTION 3. Upon receiving control of the property, the department of transportation is directed to secure the property from trespassers and remove all improvements, if any, on the property.
SECTION 4. There is appropriated out of the general revenues of the State of Hawaii the sum of $1, or so much thereof as may be necessary for fiscal year 2005-2006, to carry out the purposes of this Act. The sum appropriated shall be expended by the department of transportation.
SECTION 5. This Act shall take effect upon its approval; provided that section 4 shall take effect on July 1, 2005.
