A BILL FOR AN ACT

 

PROPOSING AN AMENDMENT TO ARTICLE xvi OF THE CONSTITUTION OF THE STATE OF HAWAII to provide for an elected public utilities commission.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The purpose of this Act is to propose an amendment to article XVI of the Constitution of the State of Hawaii to add a new section establishing an elected public utilities commission.

SECTION 2. Article XVI of the Constitution of the State of Hawaii is amended by adding a new section to be appropriately designated and to read as follows:

"PUBLIC UTILITIES COMMISSION

Section  . There shall be a public utilities commission, which shall have the general supervision of all public utilities. The commission shall be composed of three members elected at large as provided by law."

SECTION 3. The question to be printed on the ballot shall be as follows:

"Shall the Constitution of the State of Hawaii be amended to provide for the election of the members of the public utilities commission?"

SECTION 4. New constitutional material is underscored.

SECTION 5. This amendment shall take effect upon compliance with article XVII, section 3, of the Constitution of the State of Hawaii.
