A BILL FOR AN ACT

 

RELATING TO county liquor commissions.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. The legislature finds that each county should have the power to regulate the liquor commissions within their own jurisdiction. The legislature also finds that each county should have the authority to adopt ordinances that are consistent with, or more stringent than, with the intoxicating liquor state statutes.

The purpose of this Act is to provide the counties with the authority to regulate the liquor commissions in their jurisdictions and the authority to implement liquor control statutes.

SECTION 2. Chapter 281, Hawaii Revised Statutes, is amended by adding a section to be appropriately designated and to read as follows:

"§281-   County regulation and ordinances. (a) Each county shall have the power to manage and regulate the liquor commission within its own county.

(b) Each county may adopt ordinances that supersede this chapter including section 281-11 relating to composition of liquor commissions; provided that the ordinances are not less restrictive than the powers, authority, and discretion, relating to composition of liquor commissions, granted pursuant to this chapter."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on July 1, 2005.
