A BILL FOR AN ACT
relating to kewalo basin.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 200, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§200- Kewalo basin, transfer of land and operations. (a) Kewalo basin, comprising of twenty-nine acres of submerged land and all contiguous fast lands necessary for the efficient maintenance and operation of the small boat facilities there, shall be transferred from the Hawaii community development authority to the department of land and natural resources.
(b) The operation and maintenance of Kewalo basin shall be the responsibility of the department of land and natural resources.
(c) All lease rents, concessions, fees, and other revenue derived from the operation of the boating facilities at Kewalo basin shall be paid into the boating special fund and expended for purposes set forth in section 200-8."
SECTION 2. All rules, policies, procedures, guidelines, and other material adopted or developed by the department of transportation or the Hawaii community development authority to implement provisions of the Hawaii Revised Statutes that are reenacted or made applicable to the department of land and natural resources by this Act, shall remain in full force and effect until amended or repealed by the board of land and natural resources pursuant to chapter 91, Hawaii Revised Statutes. In the interim, every reference to the department of transportation or director of transportation or Hawaii community development authority or the executive officer of the Hawaii community development authority in those rules, policies, procedures, guidelines, and other material is amended to refer to the department of land and natural resources or chairperson of the board of land and natural resources, as appropriate.
SECTION 3. All deeds, leases, contracts, loans, agreements, permits, or other documents executed or entered into by or on behalf of the department of transportation or the Hawaii community development authority pursuant to the provisions of the Hawaii Revised Statutes, that are reenacted or made applicable to the department of land and natural resources by this Act, shall remain in full force and effect. Upon the effective date of this Act, every reference to the department transportation or the director of transportation or the Hawaii community development authority or the executive director of the Hawaii community development authority therein shall be construed as a reference to the department of land and natural resources or chairperson of the board of land and natural resources, as appropriate.
SECTION 4. All appropriations, records, equipment, machines, files, supplies, contracts, books, papers, documents, maps, and other personal property heretofore made, used, acquired, or held by the department of transportation or the Hawaii community development authority relating to the functions transferred to the department of land and natural resources shall be transferred with the functions to which they relate.
SECTION 5. New statutory material is underscored.
SECTION 6. This Act shall take effect on July 1, 2005.
