A BILL FOR AN ACT

 

RELATING TO CONDOMINIUM PROPERTY REGIMES.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

SECTION 1. Part V of chapter 514A, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

"§514A-   For sale signs of units on premises. No association of apartment owners or resident manager may prohibit the posting on the premises of any condominium property a sign or notice of a unit for sale in that condominium property; provided that the bylaws of the condominium may establish reasonable limits on the size and contents of the signs and the duration that the signs may remain posted."

SECTION 2. Section 2 of Act 164, Session Laws of Hawaii 2004, is amended by adding a new section to subpart C of part VI to read as follows:

"§ -158 For sale signs of units on premises. No association of apartment owners or resident manager may prohibit the posting on the premises of any condominium property a sign or notice of a unit for sale in that condominium property; provided that the bylaws of the condominium may establish reasonable limits on the size and contents of the signs and the duration that the signs may remain posted."

SECTION 3. New statutory material is underscored.

SECTION 4. This Act shall take effect on June 30, 2005.
