A BILL FOR AN ACT
relating to the office of information practices.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 92F, Hawaii Revised Statutes, is amended by adding a new section to part IV to be appropriately designated and to read as follows:
"§92F- Evaluation; report. (a) The office of information practices shall evaluate each board and commission established by law prior to the effective date of this Act and shall submit a report to the legislature not later than twenty days prior to the convening of the 2006 regular session on whether a board or commission is subject to this chapter. If the office determines that a board or commission is not subject to this chapter, the office shall state its reasons for the determination.
(b) The office of information practices shall evaluate each newly created board and commission and shall submit a report to the legislature prior to the convening of each regular session that succeeds a regular session that establishes a new board or commission on whether a newly created board or commission is subject to this chapter. If the office determines that a board or commission is not subject to this chapter, the office shall state its reasons for the determination.
(c) Each board or commission shall assist the office of information practices in collecting and reporting data as the office may require to conduct the evaluation. Even if the office of information practices finds that the board or commission is not subject to this chapter, the office shall evaluate the effectiveness and efficiency of the board or commission's information practices program and make appropriate recommendations to improve the policies, procedures, and practices. The legislature may hold a public hearing on each evaluation report.
(d) A determination of the office of information practices as to whether a board or commission is subject to this chapter shall be final unless otherwise provided for by law.
(e) The office of information practices shall provide each board or commission evaluated pursuant to this section not less than thirty days to review and comment upon its evaluation report prior to submission of the report to the legislature. If the office of information practices receives written comments from the board or commission, the office of information practices shall append the written comments to each copy of the evaluation report prior to submission to the legislature."
SECTION 2. New statutory material is underscored.
SECTION 3. This Act shall take effect upon its approval.
