RESOLUTION
requesting the auditor to conduct a management audit of the state historic preservation division of the department of land and natural resources.
WHEREAS, the historic and cultural property of Hawaii is a valued asset that must be protected and preserved for future generations; and
WHEREAS, the State Historic Preservation Division of the Department of Land and Natural Resources is entrusted with protecting, preserving, documenting, and in general, overseeing the physical cultural remains of Hawaii; and
WHEREAS, the State Historic Preservation Division is responsible for implementing chapter 6E, Hawaii Revised Statutes, and other laws pertaining to historic preservation in the islands; and
WHEREAS, the State Historic Preservation Division is also responsible for implementing the National Historic Preservation Act of 1966, as amended, including the provision in Section 106 on fulfilling consultation and review conditions for the release of federally designated funding for state projects; and
WHEREAS, the State Historic Preservation Division is also responsible for managing federal funds under the Federal Historic Preservation Grant Program; now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that the Auditor is respectfully requested to conduct a management audit of the Hawaii State Historic Preservation Division of the Department of Land and Natural Resources that covers the period from January 2003 to the present; and
BE IT FURTHER RESOLVED that in conducting the management audit, the Auditor's report is requested to address the following issues:
(1) The State Historic Preservation Division's relationship with the burial councils;
(2) Geographic information system management;
(3) Archive management;
(4) Backlog of departmental reviews and advisory opinions; and
(5) Qualifications of the division administrator;
(6) Staffing practices including position descriptions, vacancies, transition procedures, and communications during staff turnovers;
(7) Compliance under the Federal Historic Preservation Grant Program
(8) Compliance under chapter 6E, Hawaii Revised Statutes, and applicable rules, governing the project review process;
(9) Compliance with consultation responsibilities under Section 6 of the National Historic Preservation Act of 1966, as amended; and
(10) Basic management issues; and
BE IT FURTHER RESOLVED that the Auditor is requested to submit findings and recommendations, including, if necessary, any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2007; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Auditor and the Chairperson of the Board of Land and Natural Resources.
