RESOLUTION
REQUESTING THE UNITED STATES SECRETARY OF THE NAVY TO PROVIDE RENT RELIEF TO THE USS BOWFIN SUBMARINE MUSEUM AND PARK AND USS MISSOURI MEMORIAL.
WHEREAS, 10 U.S.C. §2667, allows the United States Secretary of the Navy to lease public property when it is advantageous to the United States Navy and not presently required by the Navy, under certain terms; and
WHEREAS, lease rent for any lease shall be at fair market lease rates unless the Secretary of the Navy determines that a lesser rent is in the public interest; and
WHEREAS, the USS Bowfin Submarine Museum and Park, operated by a not-for-profit corporation, has leased land from the Navy at Naval Base Pearl Harbor with an original lease executed July 1986, prior to the enactment of 10 U.S.C. §2667, for a 25-year term at a lease rent of $1 per year; and
WHEREAS, the USS Missouri Memorial Association, Inc., another not-for-profit corporation, presently leases land at Naval Base Pearl Harbor and has done so since June 1998, for the display of the Battleship Missouri, but at a fair market lease rent that has now climbed to $207,600 per year; and
WHEREAS, the Navy has indicated that the lease rent for the USS Bowfin Submarine Museum and Park will be increased to the fair market lease rate upon the termination of the present lease; and
WHEREAS, both the USS Bowfin Submarine Museum and Park and the USS Missouri Memorial:
(1) Honor former Navy ships;
(2) Commemorate the role of the Navy in the Pacific during World War II;
(3) Commemorate the sacrifices and heroism of Navy officers and sailors during World War II;
(4) Permit military ceremonies on their leased premises without charge for military service members, active and retired;
(5) Admit approximately 20,000 students and over 500,000 visitors annually for educational and memorial purposes; and
(6) Are both operated by not-for-profit corporations;
now, therefore,
BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that the United States Secretary of the Navy is requested to grant the USS Bowfin Submarine Museum and Park and the USS Missouri Memorial lease rents for the premises they occupy at Naval Base Pearl Harbor at token or substantially below fair market rates to continue to carry on the public services that each provides to the United States of America; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the President of the United States, United States Secretary of the Navy, President of the United States Senate, Speaker of the United States House of Representatives, and each member of Hawaii's Congressional delegation.
