HOUSE CONCURRENT

RESOLUTION

 

Requesting the United States Environmental Protection Agency to report on a potential contaminant spill on the island of molokai.

 

 

WHEREAS, for the past five years, on lands on the island of Molokai, described on the tax maps of the State of Hawaii as TMK: (Second Division) 5-6-07:7 and 8, there have been old and apparently derelict vehicles, large equipment, large fuel tanks, and several large barrels that are rotting away and leaking their contents on to the ground; and

WHEREAS, the lands described are in a designated wetlands and could potentially contaminate the wetlands; and

WHEREAS, many complaints concerning the potential contamination made to the Department of Health have gone unheeded and unanswered; and

WHEREAS, on November 6, 2004, following a complaint made to the United States Environmental Protection Agency, representatives of the Agency made a site inspection of the potential contamination and indicated that the Department of Health would be notified; and

WHEREAS, to date, no remedial action of any kind has been undertaken and the potential contamination remains unabated; and

WHEREAS, follow-up inquiries to the Department of Health continue to go unanswered; now, therefore,

BE IT RESOLVED by the House of Representatives of the Twenty-third Legislature of the State of Hawaii, Regular Session of 2006, the Senate concurring, that the Environmental Protection Agency is requested to disclose the following information regarding the potential contamination on TMK: (Second Division) 5-6-07:7 and 8:

(1) The findings of its site inspection;

(2) The presence of any contamination, the nature and extent of any contamination, and the type of contaminant;

(3) The extent of any damage to the environment and the wetlands;

(4) Any recommended remedial action that needs to be taken; and

(5) Any correspondence or reports transmitted to the Department of Health; and

BE IT FURTHER RESOLVED that the Environmental Protection Agency is requested to submit a report containing the foregoing information and any findings and recommendations to the Legislature not less than twenty days prior to the convening of the Regular Session 2007; and

BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Administrator of the United States Environmental Protection Agency, the head of the Environmental Protection Agency-Pacific Islands Contact Office, and the Director of Health.
